Florida Brokerage Relationship Notice

Florida law (Section 475.278, Florida Statutes) requires real estate licensees to clearly explain the types of brokerage relationships available to consumers.

Types of Brokerage Relationships in Florida

1. Single Agent (Full Representation)

In a Single Agent relationship, the brokerage represents either the buyer or the seller with full fiduciary duties.

Duties include:

  • Dealing honestly and fairly
  • Loyalty
  • Confidentiality
  • Obedience to lawful instructions
  • Full disclosure
  • Accounting for all funds
  • Skill, care, and diligence in the transaction
  • Presenting all offers and counteroffers in a timely manner

Single Agency provides the highest level of representation under Florida law.


2. Transaction Broker (Limited Representation)

In a Transaction Broker relationship, the brokerage provides limited representation to a buyer, seller, or both parties in the same transaction.

Duties include:

  • Dealing honestly and fairly
  • Accounting for all funds
  • Using skill, care, and diligence
  • Presenting all offers and counteroffers in a timely manner
  • Limited confidentiality (as defined by law)
  • Disclosing known facts that materially affect the value of residential real property

A Transaction Broker does not provide the full fiduciary duties of loyalty or full confidentiality to either party.


3. No Brokerage Relationship

In limited situations, a real estate licensee may provide services without representing either party. In this case, the licensee has only limited duties as defined by Florida law.


How MARs Realty Services Operates

MARs Realty Services may operate as either a Single Agent or a Transaction Broker, depending on the circumstances of the transaction and the written agreement signed by the parties.

The type of brokerage relationship will always be clearly disclosed in writing before or at the time of entering into a brokerage agreement, as required by Florida law.
